Piotr,

It's possible that the "brand-new and factory sealed" kit was nothing of the sort. The eBay retailer might have been trying to pass off something dodgy, hoping you wouldn't notice; or somebody else ("the distributor") may have passed it off onto him. It seems to me a fairly unlikely sort of problem to come from the manufacturer ....
