Some good points Steve. I still think it's OK to name names though, as Andy say's the rough kits shouldn't be making it as far the shelves of the hobby shops- but if you are un-lucky, after sales service is an important part of the review. We all know Accurate Armour, Resicast etc are just an email away, whereas ADV can only be contacted by carrier pidgeon (or something similar)- hence pursuing replacement parts is a pain.
On your second point, I think it's advisable for reviewers (everywhere, not just on TL) to state where the product came from. This is not to cast any aspertions on the authors' integrity, we're a pretty civilised bunch and can hopefully draw reasoned conclusions from whatever information we are given. Maybe on TL this information could be included in the review header?
